Below is a comprehensive Terms & Conditions (“T&C”) template for Plume’s EU-facing online store. It reflects current German and EU consumer-protection rules (Distance-Selling Directive 2011/83/EU, German BGB), the upcoming phase-out of the EU Online-Dispute Resolution (ODR) platform, and best-practice clauses for pricing, liability and retention-of-title.

2. Offer & Contract Formation

  1. Product presentations are non-binding invitations to order.
  2. By clicking the legally compliant button “Order with payment obligation” you place a binding order (§ 312j BGB). We confirm receipt by e-mail; the contract is formed when you receive our dispatch notice. (stripe.com)

3. Prices, Shipping Costs & Payment

  • All prices include German VAT (§ 1 PAngV) and are quoted in euros. Shipping costs are displayed separately before check-out. (stripe.com)
  • Accepted payment methods: credit/debit card, PayPal, Apple Pay, Google Pay and Klarna Pay-Later. Payment is due immediately upon conclusion of contract unless otherwise indicated.

4. Delivery & Retention of Title

  • Delivery times: 2–5 business days inside the EU, 5–10 days worldwide. These periods begin on the working day after the dispatch notice. (stripe.com)

5. Right of Withdrawal (“Cooling-Off”)

Consumers have a 14-day cooling-off period for distance contracts. (europa.eu, eur lex.europa.eu)

  • The period starts the day after you (or a third party named by you) receive the goods.
  • To exercise the right, send us a clear statement (e.g. e-mail) before the deadline.
  • You must return goods within 14 days of withdrawal and bear return postage unless the item is faulty. (europa.eu)
  • We refund all payments (including standard outbound shipping) within five business days after we receive the return.

6. Statutory Warranty

You are entitled to the two-year legal guarantee for defective goods (Articles 5–7 EU Directive 2019/771; §§ 434 ff., §§ 475 ff. BGB). (europa.eu)

7. Voluntary Second Flight™ Programme

Beyond statutory rights, Plume offers lifetime seam and snap repairs at cost price plus a take back credit of 15 €. See our Sustainability page for details (non-contractual).

8. Liability

  • We are liable without limitation for intent, gross negligence, injury to life, body or health, and under the German Product Liability Act. (lexology.com, taylorwessing.com)
  • For simple negligence we are liable only for breach of essential obligations and limited to foreseeable, typical damage.
  • Any further liability is excluded. Mandatory consumer rights remain unaffected.

9. Intellectual Property

All content on plumerain.com—designs, text, logos, images—belongs to Plume GmbH or its licensors and may not be reproduced without prior written consent.

10. Online Dispute Resolution & Consumer ADR

  • Until 20 July 2025 we still provide the mandatory link to the EU ODR platform (https://ec.europa.eu/consumers/odr) for out-of-court settlement. Note that the platform will be discontinued after that date and no new complaints are accepted since 20 March 2025. (ec.europa.eu, rpclegal.com)
  • We are neither willing nor obliged to participate in other consumer arbitration procedures (§ 36 VSBG).

11. Governing Law & Jurisdiction

Contracts are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). (paytechlaw.com)

For consumer contracts, your mandatory statutory protections under the law of your habitual residence remain unaffected (Art. 6 Rome I).

12. Severability

Should individual clauses be or become invalid, the validity of the remaining provisions shall not be affected. The statutory provision replaces the invalid clause.

13. Changes to these T&C

We may amend these T&C for future orders, e.g. due to changes in law or business processes. The version accessible on our website at the time of ordering applies.
